These Types Of Lemons Can Not Be Made Into Lemonade
August 15, 2008
Buying a lemon happens to the best and the savviest of car buyers so there is really nothing to be ashamed about. The only real irritation comes when trying to get money back for the purchase.
For a car to be a lemon the vehicle there must be a defect that compromises the vehicle’s safety, value, or use. A faulty CD player does not make the car a lemon, but faulty brakes do. Along with this the duration that the car spends in the shop is also taken into consideration when determining if the car is indeed a lemon.
Consumers that purchase a new car can be surprised to learn that lemons are not just confined to the used car market. Should there be a factory defect that is present in a line of new cars then it can not be considered a lemon since a factory recall will take car of the issue. However, if the defect is exclusive to that car then the consumer can claim the car as a lemon and start taking appropriate steps.
The United States has extensive “Lemon Laws” to protect consumers. In fact a majority of states in the U.S has such laws. These laws are in place to protect consumers who may otherwise be stuck with a car that is just not safe or that fails to properly work.
Unfortunately “Lemon Laws” are not a global concept. Australia has no such laws protecting its consumers so for residents finding themselves soured on a car there may be no recourse.
The Trades Practices Act can be used in such cases but is often an uphill battle. Should you find yourself with a lemon follow these steps.
Keep all paperwork including invoices and receipts regarding any repairs and shop time.
Start writing those letters. First to the dealership outlining the problem and include all pertinent information.
Should the dealership sour on your attempts then head straight for the manufacturing, again in writing.
After this step you may want to look into small claims court.
Fighting a lemon with not established “Lemon laws” is certainly an uphill battle but one that is worth winning if not for money then for the satisfaction of receiving a fair deal.
